Terms and conditions
These Terms & Conditions apply to all boat tours, private tours, group tours, sunset cruises and related services provided by Zara Nautica d.o.o., operating under the brand Raptor Boat Tours Zadar.
By making a booking, submitting an inquiry, paying a deposit, paying the full amount, or joining a tour, the guest confirms that they have read, understood and accepted these Terms & Conditions.
1. Booking Confirmation
A booking is confirmed only after Raptor Boat Tours Zadar confirms availability and receives the required payment, deposit or booking confirmation.
The person making the booking is responsible for providing accurate information, including name, contact details, number of guests, selected tour, preferred date, and any important health, mobility or special requirements.
Raptor Boat Tours Zadar reserves the right to refuse or cancel a booking if incorrect information has been provided, if the guest does not follow safety instructions, or if the tour cannot be operated safely.
2. Prices, Payments & Additional Costs
Tour prices are displayed on the website or communicated directly during the booking process.
Unless clearly stated otherwise, the listed price may not include all additional costs such as fuel, skipper fee, restaurant expenses, national park tickets, transfers, special requests or custom route extensions.
For private and custom tours, fuel may be charged separately according to the selected route and actual consumption. Any known additional costs will be communicated before or during the booking process where applicable.
3. Cancellation by the Guest
Guests may cancel their booking up to 48 hours before the scheduled departure time and receive a full refund of the amount paid.
Cancellations made less than 48 hours before departure are non-refundable.
No-shows, late arrivals, or failure to appear at the agreed meeting point on time may be treated as a same-day cancellation and are not eligible for a refund.
If a guest arrives late, Raptor Boat Tours Zadar may shorten the tour duration or cancel the tour, depending on the schedule and operational possibilities.
4. Weather, Sea Conditions & Safety Cancellation
All boat tours depend on suitable weather and sea conditions.
The skipper and Raptor Boat Tours Zadar have the final decision regarding whether a tour can operate safely. This decision is made in the interest of guest safety and comfort.
If the tour cannot operate due to unsafe weather, strong wind, rough sea, official warnings, technical reasons or other safety-related circumstances, guests will be offered:
1. Rescheduling to another available date, or
2. A full refund if rescheduling is not possible.
Cloudy weather, light wind, lower temperatures, minor rain risk, or changes to the planned route do not automatically qualify for a refund if the tour can still operate safely.
5. Route, Itinerary & Tour Changes
All itineraries shown on the website are examples of planned routes. Actual routes, stops and timings may change depending on weather, sea conditions, port traffic, safety, guest comfort, skipper decision, fuel range, or other operational circumstances.
Raptor Boat Tours Zadar will always aim to provide the best possible experience, but specific locations, swimming stops, restaurants, caves, beaches, islands or exact arrival times cannot be guaranteed.
If a route must be changed for safety or operational reasons, this does not automatically entitle the guest to a refund, provided that a reasonable alternative tour is offered.
6. Guest Responsibility & Safety Rules
Guests must follow the skipper’s instructions at all times.
For safety reasons, guests are not allowed to:
Jump from the boat without permission
Swim when the skipper says it is unsafe
Enter restricted areas of the boat
Behave aggressively or dangerously
Damage the boat or equipment
Bring illegal substances on board
Ignore safety instructions
Disturb other guests or crew
Raptor Boat Tours Zadar reserves the right to refuse boarding, stop the tour, return to port, or remove guests from the tour if their behaviour creates risk, damage, disturbance or danger.
In such cases, no refund will be issued.
7. Alcohol, Behaviour & Damage
Moderate alcohol consumption may be allowed where appropriate, but the skipper may limit or refuse alcohol consumption for safety reasons.
Guests are responsible for any damage they cause to the boat, equipment, seats, safety gear, sound system or other property.
The guest who made the booking may be held responsible for damage caused by members of their group.
8. Health, Mobility & Personal Conditions
Guests are responsible for ensuring they are physically and medically fit to join a boat tour.
Guests must inform Raptor Boat Tours Zadar before departure about any relevant medical condition, injury, pregnancy, mobility limitation, recent surgery, back problems, severe seasickness, allergies or other condition that may affect their safety or comfort.
Raptor Boat Tours Zadar may refuse boarding if participation could create a safety risk for the guest, other guests or crew.
9. Children
Children are welcome on board but must be supervised by a parent, guardian or responsible adult at all times.
The skipper may require children to wear life jackets during the tour. Parents or guardians are responsible for the behaviour and safety of children in their group.
10. Personal Belongings
Guests are responsible for their own personal belongings, including phones, cameras, sunglasses, bags, wallets, jewellery, clothing and electronic devices.
Raptor Boat Tours Zadar is not responsible for loss, theft, water damage or damage to personal belongings during the tour.
Guests are advised to bring only necessary items and protect valuables from sea water.
11. Swimming, Snorkeling & Activities
Swimming, snorkeling and other water activities are done at the guest’s own risk.
Guests must only enter the sea when permitted by the skipper and must return to the boat when instructed.
Raptor Boat Tours Zadar is not responsible for injuries or incidents caused by unsafe swimming, jumping, diving, snorkeling, contact with rocks, sea urchins, marine life, other boats, or failure to follow instructions.
12. Liability
Zara Nautica d.o.o. and Raptor Boat Tours Zadar are not liable for delays, cancellations, route changes, reduced tour duration, missed connections, missed restaurant bookings, loss of enjoyment, indirect costs, or other losses caused by weather, sea conditions, technical issues, port authority decisions, traffic, guest delays, force majeure or circumstances beyond reasonable control.
Nothing in these Terms & Conditions excludes liability where such exclusion is not permitted by applicable law.
13. Force Majeure
Raptor Boat Tours Zadar is not responsible for failure or delay in performing its services due to circumstances beyond its control, including but not limited to severe weather, unsafe sea conditions, natural disasters, technical failures, government restrictions, port authority decisions, accidents, strikes, illness, emergencies or other events outside normal control.
14. Photos & Videos
Photos and videos may be taken during the tour for promotional and marketing purposes, including use on the website, social media, advertisements and booking platforms.
Guests who do not wish to appear in photos or videos should inform the crew before departure.
15. Website Information
Raptor Boat Tours Zadar aims to keep all website information accurate and updated. However, photos, descriptions, prices, routes, availability and tour details may change without prior notice.
Images on the website are for presentation purposes and may not always show the exact conditions, weather, sea state or route on the day of the tour.
16. Complaints
Any complaint should be reported to the skipper or Raptor Boat Tours Zadar as soon as possible during the tour, so that we have an opportunity to resolve the issue immediately.
Complaints submitted after the tour will be reviewed, but refunds or compensation are not guaranteed unless the complaint is justified and supported by clear circumstances.
17. Governing Law
These Terms & Conditions are governed by the laws of the Republic of Croatia.
Any disputes shall first be attempted to be resolved amicably. If this is not possible, the competent court in Croatia shall have jurisdiction, unless mandatory consumer protection rules provide otherwise.
